We collect personal information that we need in order to deliver our services to you. We collect personal information directly from you when you access our services or engage with us through our website, social media accounts and surveys.

If you access any of our services, we will collect some or all of the following personal information:

• Personal financial information.
• Personal health information.
• Your comments and feedback.
• Survey results and responses, when you participate in any of our surveys.

When you visit our website we also collect information about your visit using cookies to gather some of this information. (We explain this is more detail below). Collectively, this is known as your “personal information”.

You can choose not to provide us with this information, but it may limit what we can do for you and relevancy of future information that we can provide you.

Digital Information We Collect From You
To improve your experience using our Website marketing and to gather Website analytics we use web management tools including cookies to record information about your visit. This includes:
• Remarketing and emails: we use third party cookies to keep track of the content you’re interested in and remarket it to you when you leave our site (as a result, you may see ads from us when you visit other websites).
• Impression reporting: we use web beacons to estimate the number of users that have viewed and clicked on our advertisements (as a result, we’re able to gauge the success of a campaign).
• Demographics and interest reporting: we use cookies and web beacons to get an overview of our readership broken down by age, gender and relevant interests. As a result, we can provide you with relevant information, services and features and also gauge the popularity of our content.
We use Google Analytics to collect information about your visit and use that information to improve our Website. We don’t use Google Analytics to track, collect, or match information in a way that could personally identify you.

Google Analytics collects:
• The country you’re in
• Your age and gender
• The platform you used to find us (such as Facebook, Twitter, or Google search)
• The browser and operating system you used
• The network you used
• The kind of device you used
• Where in our website you went, and for how long
• Whether you came to our site from one of our targeted campaigns or Google Ads.

Google Analytics stores the information it collects outside New Zealand.

We do not control what information Google Analytics (or other online platforms) collect/s or where it is stored, although as explained above, our Website makes use of some information shared by Google Analytics and Facebook with us. Check your Google, Facebook and other browser/app settings, including their cookies, to understand and be comfortable with the personal information those third parties may be collecting about you, and how they are using and storing it.

You can opt out of Google Analytics without affecting how you visit our site.

2. USING YOUR INFORMATION
In order to deliver our services, we use your personal information in the ways set out below. If we need to use information in a way not outlined below, we will only do so if required or permitted by law or with your authorisation.

We use your personal information to:

• Help us to understand your financial needs so that we can provide you quality products and services and continually improve our offerings.

• Invoice you, or receive payment from you, for any of our services that require payment.
• Conduct market research surveys if you elect to participate.
• Target or customise our educational content and information, marketing and advertising.

• Provide you with information about the operation and security of our websites.
• Contact you to advise you of changes to our terms and conditions, services or new financial products or promotions.
• Email communications.

All clients will be signed up to automatically to receive email marketing communications, including surveys. For all our marketing emails, you can choose to remove yourself from receiving these communications by following the “unsubscribe” prompt at the bottom of each email.

Sometimes, we might want to use testimonials you may send us in our articles or marketing material. If so, we will endeavour to get your permission before copying or quoting your message.

We may use your information in accordance with any other purposes that you have authorised.

3. SHARING YOUR INFORMATION
We share your personal information with trusted third parties that require your information in order to:
• Provide you with a service and/or product that you have requested.
• Provide marketing services on behalf of Smart Adviser.

We do not authorise third parties to use or disclose your personal information except for the purpose of providing the service and/or product we request from them.

All third parties which we disclose your personal information to are subject to obligations under the New Zealand Privacy Act 2020 to protect your information from unauthorised use or disclosure.

Smart Adviser does everything we reasonably can to protect your information from unauthorised use or disclosure by any third party that we engage. This includes ensuring the third party has their own privacy and data protection statement, has had no significant privacy breaches and complies with their own statements and relevant legislation, to the extent we can access that information.

The only other time we’ll share your personal information is when it’s necessary to comply with the law (for example, to help with investigating a criminal offence, or sharing information with Inland Revenue or the Financial Markets Authority).

If we or substantially all of our assets were sold to a third party, user and customer information would be one of the assets that are likely to be transferred or acquired in the normal course of the transaction. You acknowledge that such transfers may occur and that any acquirer of us or our assets may continue to use your personal information as set forth in this policy.

Retention of Information
Call information is securely stored for up to 10 years after the date of a call with Smart Adviser. After this time, the call information will be securely destroyed. Other information is held for as long as you are a client with us. Once the relationship no longer exists, your personal information will be securely held for a minimum of 7 years before being securely destroyed (both in hard and electronic copy).

 

4. YOUR PRIVACY RIGHTS
You have the right to request access to and correct any personal information we hold about you at any time. You can contact us by emailing support@SmartAdviser.co.nz or calling us on 0800 FIN FREE (346 3733).

Rights of access
You have the right to request a copy of the personal information we hold about you. When any such request is received, we will process your request as soon as possible and provide you with our decision on your request within 20 working days after your request. We will also take steps to verify your identity before providing you with any requested personal information.

Right to correct
You have the right to ask us to correct your information if you think it is wrong.

Complaints
We are committed to dealing quickly and appropriately with any privacy complaints. If you are concerned this privacy statement may have been breached or your privacy has been compromised, please email us immediately to Support@SmartAdviser.co.nz or call us on 0800 FIN FREE (346 3733).

5. CHANGES TO THE PRIVACY POLICY
We may amend this Privacy Policy from time to time. Use of information we collect now is subject to the Privacy Policy in effect at the time such information is used. If we make major changes in the way we collect or use information, we will notify you by posting an announcement on the website or by sending you an email. A user is bound by any changes to the Privacy Policy when he or she uses the services after such changes have been first posted.

 

6. LINKS TO OTHER WEBSITES
We are not responsible for the websites we link to. A link to another site doesn’t mean we support any or all of the content on that site. We’re not responsible for the content of websites we link to or the privacy practices of those websites and we have no control over the activities of those websites.

Smart Adviser does not accept responsibility for the compliance of this information with the laws of any other country. The laws of New Zealand shall govern your use of the website and by visiting this website you hereby agree to submit to the exclusive jurisdiction of the New Zealand courts.

Although Smart Adviser regularly updates its virus protection software, it does not warrant that the server that makes the information and contents of this website available is free of viruses or bugs.
